Office of the President UNIVERSITY MANAGEMENT LETTER NO. 90-2 Copying Policy June 4, 1990 It is University policy to adhere to the provisions of the Copyright Revision Act, Title 17 of the United States Code, (Public Law 94-553). This policy, enumerated below, is based on the Guidelines for Classroom Copying in Not-for-Profit Educational Institutions, as published in the House Judiciary Committee Report on the Copyright Bill. 1. Allowable copying from copyrighted material. 1.1. A single copy may be made of the following: 1.1.1 A chapter from a book. 1.1.2 An article from a periodical or newspaper. 1.1.3 A short story, short essay or short poem. 1.1.4 A chart, a graph, a diagram, a drawing, a cartoon, or a picture. 1.2. Multiple copying for classroom use is permitted if the following conditions are met: 1.2.1 Brevity a. A complete poem, if less than 250 words, or an excerpt of 250 words from a longer poem. b. A complete article, story, or essay, if less than 2,500 words, or not more than 1,000 word excerpt from a longer work. c. One chart, diagram, drawing, cartoon, or picture from a book or periodical. 1.2.2 The copying is at the instance and inspiration of the moment, and the decision to use the work and the moment of its use for maximum effectiveness are so close in time that it would be unreasonable to expect a timely reply to request for permission. 1.2.3 Cumulative effect a. The copied material is for use in only one course. b. Not more than one short work or two excerpts may be copied from the work of the same author, nor more than three excerpts from the same collective work or periodical volume during a school term. c. There shall not be more than nine instances of such multiple copying for one course during a school term. 1.2.4 A notice of copyright shall be included on each copy. (Note: Prohibitions in 1.2.3.b and 1.2.3.c above do not apply to current news periodicals or newspapers and current news sections of other periodicals.) 2. Those who wish to duplicate copyrighted works to a greater degree or quantity than allowed in the guidelines under section 1 must first obtain permission from the copyright owner. It is the responsibility of the individual to seek and obtain clearance from copyright owners prior to duplication. University staff will not make copies of copyrighted material outside the guidelines without knowledge that a clearance has been granted. 3. Notwithstanding the allowable copying noted in section 1 above, the following prohibitions must be observed: 3.1. Copying shall not be used to create or to replace or substitute for anthologies, compilations, collective works or any non-print media. 3.2. There shall be no copying of works intended to be consumable, such as workbooks, exercises, standardized tests and test booklets and answer sheets. 3.3. Copying shall not substitute for the purchase of books, non-print media, publisher's reprints or periodicals; shall not be directed by higher authority, and shall not be repeated with respect to the same item by the same faculty member from term to term. 3.4. Duplication of copyrighted motion picture films, slides, audio cassettes, phonograph records, or videotapes is prohibited except as allowed in the University Policy for Media Reproduction. 3.5.
